If we grow these varieties ourselves, we pay a royalty which is included in the listed retail price. We are happy to
endorse this scheme which encourages the development of new
varieties and are happy to pay the usual royalty on sales of any
relevant variety provided it has been registered and is published
on the relevant website lists as a protected variety. Where a
quantity discount is offered this is applied to the initial order
only. I am unable to apply a larger discount if a subsequent
addition to the original order means the new total number of trees
would have originally qualified for a larger discount. |

2) Delivery & Returns
The Office of Fair Trading sets out regulations that apply to
distance selling which allow the customer to return the goods if for
any reason you are not happy with them. When you receive them you have
the right to return them within 10 working days for a refund. The
refund will however, only be for the cost of the goods, not
the outgoing delivery. You are also required to pay the cost for the
return of the goods. The goods must be returned in good condition.
If there is any major damage in transit this must be reported to the
carrier at the time of delivery, and signed for as damaged, otherwise
is it not possible to claim this damage from the carrier insurance. I
work very hard to ensure that neither of these issues arise and if, on
the very rare occasion they do, I work hard to ensure there is a fast
successful resolution. If a variety error occurs with your order I
undertake to either replace the tree or refund the original price
paid. That is the full extent of my liability. I reserve the right to
examine the tree to verify. Please be assured that I have rigorous
procedures in place to minimise the possibility of this and it is an
extremely rare occurrence. When your delivery is ready I must ask you
to accept it unless there is a pre agreed delivery date (meaning a
'not before' date). I am unable to delay a delivery once the order is
lifted and packed.
When you make payment for your order, the tree(s) become your
property. I will despatch them to you as soon as it is possible to do
so. If for any reason I am unable to do this (examples might be
subsequent crop failure, mechanical damage, excessive growth making
carrier delivery impossible) then my liability to the customer is for
the order value only. I will refund the money you have paid in full
but that is the full extent of my liability and placing an order with
me means you accept this condition. |
